This Privacy Policy explains how Capsule ("we," "us," or "our") collects, uses, discloses, and protects information about you when you use the Capsule application and related services (the "Service"). By using the Service, you agree to the collection and use of information in accordance with this policy.

1. Information We Collect

1.1 Information You Provide Directly
  • Account registration: name, email address, password (stored in hashed form), and date of birth
  • Profile information you choose to add
  • Content you create: capsule messages, notes, and photos
  • Recipient information: names and email addresses of people in your group
  • Delivery instructions: scheduled delivery dates and preferences
  • Communications with us: support requests, feedback, and correspondence
1.2 Information Collected Automatically
  • Device identifiers: IP address, device type, operating system, browser type and version
  • Usage data: pages visited, features used, time spent, clicks, and interactions
  • Log data: server logs, error reports, and diagnostic information
  • Cookies and similar tracking technologies (see Section 6)
  • Approximate geolocation derived from IP address (not precise GPS location)
1.3 Information from Third Parties

If you use social sign-in (e.g., Google, Apple), we receive your name, email, and profile photo from that provider.

1.4 Children's Information (COPPA)

We do not knowingly collect personal information from children under 13 without verifiable parental consent. Users aged 13–17 require parental consent. If you believe your child has provided us personal information without consent, contact us at privacy@ourcapsule.co and we will promptly delete such information.

2. How We Use Your Information

  • To create and maintain your account and provide the Service
  • To store, encrypt, and deliver your capsules at the designated time
  • To send delivery notifications to group members
  • To communicate with you about your account, service updates, and support
  • To improve, personalize, and develop the Service
  • To analyze usage trends and monitor for technical issues
  • To detect, investigate, and prevent fraudulent, abusive, or illegal activity
  • To enforce our Terms of Service and legal obligations
  • To comply with applicable laws, regulations, and court orders
  • To protect the safety and security of users and the public

3. Legal Bases for Processing

Depending on your state of residence, we process your personal information on the following legal bases:

  • Performance of a contract: processing necessary to provide the Service you requested
  • Legitimate interests: improving the Service, preventing fraud, and ensuring security

4. How We Share Your Information

4.1 With Group Members

When a capsule is delivered, its content is shared with the group members you designated. You are solely responsible for ensuring you have appropriate consent to send content to those individuals.

4.2 Service Providers

We share information with third-party vendors who help us operate the Service, including cloud hosting, email delivery, analytics, and customer support. These providers are contractually obligated to use your data only as directed by us.

4.3 Legal Requirements

We may disclose your information if required by law, subpoena, court order, or government request, or if we believe in good faith that disclosure is necessary to protect rights or safety.

4.4 Business Transfers

If Capsule is involved in a merger, acquisition, or asset sale, your information may be transferred as part of that transaction. We will notify you before your information becomes subject to a different privacy policy.

4.5 What We Do Not Do
  • We do not sell your personal information to third parties
  • We do not share your personal information with advertisers
  • We do not use your capsule content to train AI or machine learning models
  • We do not share your capsule content with any party other than your group members, except as required by law

5. Data Retention

We retain your personal information for as long as your account is active or as necessary to provide the Service. Capsule content is retained until delivery is complete and you delete the record, you delete the capsule, or you delete your account.

After account deletion, we may retain information in backups for up to 90 days, after which it is permanently deleted. We retain transaction records for up to 7 years as required by applicable law.

6. Cookies and Tracking Technologies

We use cookies and similar technologies to operate and improve the Service:

  • Essential cookies: required for authentication and session management
  • Analytics cookies: help us understand how users interact with the Service
  • Preference cookies: remember your settings and preferences

You can control cookies through your browser settings. Disabling certain cookies may affect functionality. We honor applicable opt-out requests under state law.

7. Data Security

We implement industry-standard security measures including:

  • Encryption of data in transit using TLS
  • Encryption of stored content at rest
  • Access controls limiting employee access on a need-to-know basis
  • Regular security assessments and vulnerability testing
  • Incident response procedures

No method of transmission or storage is 100% secure. In the event of a data breach affecting your rights, we will notify you and applicable authorities as required by law.

8. Your Rights and Choices

8.1 All Users
  • Access: request a copy of the personal information we hold about you
  • Correction: request correction of inaccurate or incomplete information
  • Deletion: request deletion of your account and personal information
  • Portability: request your data in a portable, machine-readable format
  • Opt-out of marketing: unsubscribe at any time via the link in any email
8.2 California Residents (CCPA/CPRA)

California residents have additional rights including the right to know what information is collected, the right to delete, the right to correct, and the right to opt out of the sale or sharing of personal information (we do not sell personal information). 8.3 Other State Residents

Residents of Virginia, Colorado, Connecticut, Texas, and other states with comprehensive privacy laws have similar rights. Please contact us to exercise your rights under applicable state law.

9. Third-Party Links and Services

The Service may contain links to third-party websites or integrate with third-party services. This Privacy Policy does not apply to those third parties. We encourage you to review their privacy policies.

10. International Users

The Service is operated in the United States. If you access the Service from outside the United States, your information will be transferred to and processed in the United States, where privacy laws may differ from those in your jurisdiction. By using the Service, you consent to this transfer.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the new policy on this page with an updated effective date and, where required by law, by sending you an email notification. Your continued use of the Service after changes are posted constitutes acceptance of the updated policy.
